Birth injury leaves child with permanent neurological injuries

The birth of a child should be the happiest moment in a person's life. Unfortunately, sometimes things go wrong. The jury awarded the family $4 million after the child suffered cerebral palsy and other neurological injuries. The family reportedly sued the obstetrician for negligence after the doctor ensured the mother a cesarean section was not necessary despite an ultra sound showing the child was 10 pounds.

According to the suit, during the course of the delivery the baby got stuck and was deprived of oxygen for approximately three and a half minutes. As a result of the deprivation of oxygen, the child was transferred to undergo a procedure in which the brain is cooled to minimize potential brain damage. An expert witness for the plaintiff testified that the child's size should have been a sign a cesarean was safer than natural childbirth.

Delivery errors can have profound consequences. With a small child, even minor medical errors can result in developmental or cognitive disabilities such as cerebral palsy or mental retardation.
