Surgical errors vs. surgical complications in Maryland

In the Maryland operating room, the difference between a surgical error and a surgical complication can result in an infection or even a loss of life. At times, there is a fine line between the two. There are also moments when the difference is profound. Bringing to light the difference is not only a matter of health, it can also be a legal concern, especially if Maryland patients who suffer injuries wish to file a medical malpractice lawsuit.

However, patients should be aware that hospitals and doctors will not just award a case to a patient. They have to fight for it. Based on experience, the biggest dispute a defendant will probably use is that medical risks were discussed with the patient, a consent form or waiver was signed and that despite doing everything, injuries or fatalities can still occur. Although this seems to make sense, the patient's well-being is in the hands of the surgeon.

Legal professionals, armed with many years of knowledge and experience in handling medical malpractice cases, are talented at exposing surgical errors. We also have information on medical negligence cases, like anesthesia errors, which can be equally fatal, surgeons' faulty techniques, nicked arteries, wrong-site surgery and the inability of a doctor to determine when the situation requires surgery. Post-operational procedures can also be scrutinized.

Once a legal professional's findings confirm that the injury or death of a Maryland patient was due to negligence, the person who filed the legal action should not be complacent. Defendants often offer a settlement to plaintiffs. Although the offer may seem appropriate, it is best to seek legal guidance before agreeing on the settlement.
