Amputation leads to misdiagnosis lawsuit in Maryland

Parents of a 6-year-old double-amputee filed a medical malpractice lawsuit in Anne Arundel Circuit Court last week. The Maryland parents say a doctor and hospital are liable for failure to treat an infection by not giving their child the proper medical treatment he badly needed. They believe that a failure to properly treat their son's infection with antibiotics led to the amputation of both of his legs.

The parents rushed the boy to the hospital this past December because of a fever, swollen tonsils and an increased heart rate.

Upon noticing that the boy's tonsils were swollen, the doctor failed to perform a strep test, according to the boy's mother. The doctor in the case previously had a clean safety record in Maryland

The child now uses a wheelchair and is in good spirits although the family is distraught over the ordeal.

Hospital representatives offered the family its condolences, but suggested that the medical care provided to the boy was appropriate in this case.

The loss of both of his legs will undoubtedly have a severe impact on this child's quality of life. In their lawsuit, the family is seeking more than $30,000 in damages. However, future medical expenses and assistive devices that will be needed to help this child live a normal life will be much more expensive.

The family estimates that they will need about $15 million related to their child's expenses over his lifetime. The family and their attorney feel the child showed clear signs of a very severe infection and that the doctor failed to order the correct tests.
