Family seeks damages from hospital and state for birth injuries

There is little worse a new parent could imagine than learning that something went wrong during the birth of their child. However, when that nightmare was preventable and the result of hospital negligence, a medical malpractice lawsuit may be filed.

Maryland parents might be interested to learn about a Washington, Iowa, couple that is suing the state of Iowa and the University of Iowa Hospitals and Clinics after a cesarean section resulted in serious injuries to both a mother and her newborn child.

The incident took place back in February 2008. The parents of the now 4-year-old boy were nearly eight hours into labor when the mother was taken to an operating room for a C-section. It was then that a 3 centimeter laceration was made into the woman's bladder. The injury was repaired by a urogynecologist, but the mother still developed a serious infection and bowel obstruction.

The child was also injured during the procedure. Skull imaging showed that he had a skull fracture and several areas of subdural hemorrhage.

The family alleges that the state is liable for the negligence of UIHC staff. The family says that the hospital staff did not provide the level of skill and care possessed by other medical professionals. The family is now seeking damages for their injuries and for their child's injuries.

Medical malpractice claims are complicated, especially when it comes to birth injuries. Delivery errors can often have life-long effects. When it is believed that negligence or outright error is to blame for a birth injury in Maryland, a lawsuit could help the family by providing financial compensation to help cover medical costs, loss of future earning and pain and suffering.
