Birth injury lawsuit results in $78.5 million verdict

The parents of young children or couples considering having children in Maryland might be interested to learn about a recent medical malpractice suit involving the parents of a child who suffered brain damage as a result of a birth injury.

The medical malpractice lawsuit was brought in the Philadelphia Court of Common Pleas and a jury reached a decision earlier this month. The jury in the case found that the severe spastic quadriplegic cerebral palsy suffered by the child occurred because of an 81-minute delay in performing an emergency cesarean section. According to the doctor, he believed the baby to be dead. The hospital expressed its disappointment with the verdict, which may cost the hospital more than $78 million.

According to the attorney who represented the family in the lawsuit, the attending physician performed an ultrasound with outdated and poorly maintained equipment. The attorney submitted evidence that the ultrasonography equipment was antiquated and lacked the sensitivity of modern ultrasound machines. The hospital's risk manager even admitted in court that the medical equipment had likely not been serviced in more than 10 years.

The physician who brought the young child into the world maintained that he performed the ultrasound properly and that he did not identify the fetal heartbeat. An ultrasound technician was not available to verify the doctor's findings, which were later determined to be incorrect.

After hearing all of the evidence, the jury came back with a $78.5 million damage award, which included payments for future medical care, lost earnings, pain and suffering. While nothing can fix what went wrong, at least the family knows that they will now be able to provide for their permanently injured child throughout the entirety of her life.
