Family receives $7 million following birth injury

Childbirth is supposed to be one of the happiest moments in a person's life. Unfortunately, sometimes things can go very wrong. When things do go wrong, such as a labor error or delivery error that results in harm to the child or the mother, the injured party may be entitled to monetary damages. Maryland readers may be interested in the following blog about a recent birth injury malpractice suit that recently settled in Los Angeles County.

It was recently reported that the Los Angeles County Board of Supervisors has agreed to approve a $7.5 million dollar settlement payment to a toddler born with a brain injury. According to reports, the family of the child filed the lawsuit on behalf of the 18-month-old boy after the mother suffered a ruptured uterus depriving the infant of oxygen during delivery. The delivery error left the child with severe brain damage.

The attorney for the young child said the injuries were preventable. The mother apparently went to the Los Angeles County-USC Medical Center for severe abdominal pain but was discharged shortly thereafter. The mother returned to the hospital 12 hours later and underwent a C-section. The lawsuit also said that during the 14 hours in the labor unit the mother was not seen by any of the three attending obstetricians.

If a child or mother is injured due to medical errors or delivery errors during childbirth, the family may be able to collect damages. In many cases involving childbirth injuries, an infant can suffer serious, life-long injuries that require long-term and costly medical care. With so much on the line, both now and in the future, a medical malpractice suit may be the only option available to provide the care the child will need.
