MLB prospect sues for failure to diagnose shoulder injury

If a physician in Maryland fails to accurately diagnose an injury or illness in a timely fashion, the delay in treatment can cause serious complications. In the case of professional baseball pitcher Andrew Rohrbach, doctors' failure to diagnose his shoulder injury may have cost him his career. Rohrbach is now filing a lawsuit against the Colorado Rockies for negligence with regards to his shoulder injury.

Rohrbach was pitching in college and was drafted in the ninth round by the Rockies in 2014. He had already had Tommy John surgery on his shoulder. Rohrbach claimed the Rockies' medical staff ran an MRI on his right shoulder during an entrance physical and scanned it again two months later. When Rohrbach got an independent MRI on the shoulder shortly thereafter, the results apparently showed a tear of his right labrum.

The Rockies' medical staff allegedly continued to claim there was nothing wrong with his shoulder, even after Rohrbach sent them the independent MRI results. The Rockies ordered another MRI after spring training and told Rohrbach about a less serious subscapularis muscle tear, but failed to mention the torn labrum. After another MRI two months later, the team told him to rest to heal the subscapularis muscle tear. He returned to pitching a few months later in December 2015, and went to spring training in 2016.

Rohrbach was cut in March 2016 and obtained another MRI scan, which revealed a torn labrum and capsular tear. He had surgery to fix the tears, but, according to Rohrbach, failing to treat the shoulder earlier made the injuries more severe and required a more invasive surgery. As a result, Rohrbach claims that he is unable to continue playing baseball. If the courts find that the doctors' failure to diagnose Rohrbach's injury ended his career, Rohrbach could recover damages.
